Insito Health (Medfinder) Terms of Service
Welcome to Medfinder! These Terms and Conditions govern your use of the Medfinder website and services (collectively referred to as the “Service”), operated by Insito Health Inc. (“we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Service.
1. Description of Service
Medfinder is a digital platform that provides support to individuals and health care practitioners in locating pharmacies and checking medication availability. Our service helps users find pharmacies near them and determine which pharmacies are able to fill the desired prescription.
2. Eligibility
You must be at least 18 years old to use Medfinder. By using the Service, you represent and warrant that you meet this requirement.
3. No Medical Advice
Medfinder is not a healthcare provider, pharmacy, or medical advice service. The content on the Platform is for informational purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or another qualified health provider with any questions regarding a medical condition.
4. User Accounts
To access certain features, you may be required to create an account. You agree to provide accurate and complete information, maintain the confidentiality of your login credentials, and be responsible for all activity that occurs under your account.
5. Acceptable Use
5.1 General Restrictions
You agree not to:
- (a) use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- (b) impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- (c) access or use the Service through any automated means, including bots, crawlers, scrapers, or scripts, without Medfinder's prior written authorization;
- (d) circumvent, disable, or attempt to circumvent any rate limits, CAPTCHAs, authentication mechanisms, IP-based restrictions, or other technical access controls applied to the Service;
- (e) create accounts under false pretenses, operate multiple accounts to evade detection or restrictions, or use IP rotation, residential proxies, or similar techniques to disguise access;
- (f) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, structure, or underlying logic of the Service, except to the extent this restriction is prohibited by applicable law;
- (g) probe, scan, or test the vulnerability of the Service, or introduce any virus, malware, or other malicious code; or
- (h) interfere with or disrupt the operation, integrity, or security of the Service or the data contained therein.
Medfinder may revoke your authorization to access the Service, in whole or in part, at any time and for any reason, including by written notice, by blocking your IP address or account, or by updating its robots.txt file or other technical signals. You agree to honor Medfinder's robots.txt and any other technical signals indicating restricted access.
5.2 Medfinder Data
(a) Definition. “Medfinder Data” means all data, metrics, snapshots, methodology, content, and compilations made available through the Service, including without limitation our shortage tracker data, medication availability metrics, regional availability snapshots, public JSON feeds, and related methodology pages, whether displayed on the website, returned by any API or data feed, or otherwise made accessible. Medfinder Data does not include third-party source materials that Medfinder identifies as such, including without limitation FDA records, state board of pharmacy postings, and manufacturer notices.
(b) Permitted Use. Subject to your compliance with these Terms, you may use Medfinder Data solely for: (i) personal, non-commercial use; (ii) patient-care purposes by licensed healthcare providers or their authorized staff; or (iii) internal informational purposes within your organization. Any external use of Medfinder Data permitted under this Section must include reasonable attribution to Medfinder.
(c) Prohibited Use. Except with Medfinder's prior written permission or under a separate written agreement, you may not, and may not permit or enable any third party to:
- (i) scrape, crawl, harvest, index, bulk download, or otherwise extract Medfinder Data by automated means;
- (ii) cache, other than transient caching incidental to ordinary browsing, copy, reproduce, republish, distribute, display, sell, license, or sublicense Medfinder Data;
- (iii) use Medfinder Data to train, fine-tune, validate, or evaluate any machine learning model, large language model, or other artificial intelligence system;
- (iv) use Medfinder Data for competitive analysis, benchmarking, market research, or lead generation;
- (v) use Medfinder Data to build, support, market, operate, or improve any product or service that competes with the Service, including without limitation medication availability platforms, drug shortage trackers, pharmacy locators, prescription routing services, or direct-to-consumer healthcare navigation tools; or
- (vi) remove, alter, or obscure any proprietary notices, attribution, or methodology disclosures associated with Medfinder Data.
(d) Discretionary Permissions. Journalists, academic researchers, and public health organizations may request limited-use permission by contacting partnerships@medfinder.com. Medfinder may grant, deny, or condition such permission in its sole discretion.
(e) Enforcement. You acknowledge that any breach of this Section 5.2 will cause Medfinder irreparable harm for which monetary damages would be inadequate, and that Medfinder is entitled to seek injunctive and other equitable relief without the requirement of posting a bond, in addition to all other remedies available at law or in equity. Medfinder may embed canary or signature data within Medfinder Data for detection purposes, and unauthorized use of such data is itself evidence of breach. The obligations in this Section 5.2 survive any termination of your access to the Service.
6. Data and Privacy
Our collection and use of personal data is governed by our Privacy Policy and Consumer Health Data Privacy Policy. By using the Service, you consent to our use of your data as described.
7. Disclaimers
The platform is provided “as is” without warranties of any kind. We do not guarantee the availability, accuracy, or reliability of any medication information. We are not liable for any medical or purchasing decisions made based on content on the Service.
8. Limitation of Liability
To the maximum extent permitted by law, Medfinder shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, and without liability. You may stop using the Service at any time.
10. Updates and Changes to This Policy
We may update these Terms of Service from time to time. We will post those changes here or on a similarly accessible page.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Massachusetts, without regard to its conflict of law principles.
